ELKE Seller Terms & Conditions

By registering on ELKE, you agree to comply with these Terms & Conditions.

1. About ELKE

ELKE is an online business listing platform dedicated to promoting women-owned businesses. ELKE connects potential customers with registered sellers by providing an online directory, business profile, product/service showcase and enquiry generation facility.

ELKE acts only as a technology platform and is not a buyer, seller, manufacturer, distributor or agent of any listed business. Similar business listing platforms generally position themselves as intermediaries rather than parties to transactions.

2. Eligibility

To register on ELKE, the Seller must:

  • Be at least 18 years of age.
  • Be a woman entrepreneur or an authorised representative of a women-owned business.
  • Provide accurate business information during registration.
  • Submit identity and business documents as requested for verification.
  • Maintain updated contact details at all times.

ELKE reserves the right to approve or reject any application.

3. Business Information

The Seller agrees that:

  • All information provided is true and accurate.
  • Product and service descriptions are genuine.
  • Images uploaded belong to the Seller or are used with proper permission.
  • False or misleading information shall not be published.

4. Listing Services

ELKE provides:

  • Business profile listing
  • Product and service showcase
  • Customer enquiry generation
  • Contact information display
  • Business promotion through ELKE’s digital platforms

ELKE does not guarantee any minimum number of enquiries, customers or sales.

5. Subscription Fee

  • Sellers shall pay the applicable subscription fee.
  • Subscription fees are non-refundable once the listing is activated.
  • Renewal fees shall be payable before the expiry of the subscription period.
  • Failure to renew may result in suspension or removal of the listing.

6. Direct Transactions

Customers contact Sellers directly.

The Seller is solely responsible for:

  • Pricing
  • Product quality
  • Availability
  • Delivery
  • Customer service
  • Warranty
  • Returns
  • Refunds
  • Taxes applicable to the Seller’s business

ELKE is not responsible for any transaction, dispute or loss arising between buyers and sellers.

7. Compliance with Laws

The Seller shall comply with all applicable laws and regulations, including any registrations or licences required for their business or products.

Where GST registration is legally applicable to the Seller, the Seller shall comply with the relevant tax laws.

8. Prohibited Listings

The following are prohibited:

  • Counterfeit products
  • Illegal goods or services
  • Offensive or obscene material
  • Products violating intellectual property rights
  • Misleading advertisements
  • Products prohibited under Indian law

ELKE may remove such listings without prior notice.

9. Intellectual Property

The Seller retains ownership of their logos, photographs and content.

By uploading content to ELKE, the Seller grants ELKE a non-exclusive, royalty-free licence to use, display and promote such content for marketing the Seller and the Platform.

10. Seller Responsibilities

The Seller shall:

  • Respond promptly to customer enquiries.
  • Maintain professional conduct.
  • Keep business information updated.
  • Deliver products or services as promised.
  • Resolve customer complaints directly.

11. Ratings and Reviews

Customers may submit reviews based on their experience.

ELKE reserves the right to remove fake, abusive or defamatory reviews.

12. Suspension or Termination

ELKE may suspend or terminate a Seller’s listing without refund if:

  • False information is provided.
  • Fraudulent activities are detected.
  • The Seller repeatedly receives serious complaints.
  • These Terms are violated.
  • The Seller engages in activities that may damage ELKE’s reputation.

13. Limitation of Liability

ELKE functions only as a business discovery and listing platform.

ELKE shall not be liable for:

  • Product defects
  • Service quality
  • Payment disputes
  • Delivery delays
  • Customer dissatisfaction
  • Business losses
  • Indirect or consequential damages

14. Privacy

Seller information shall be collected and used in accordance with ELKE’s Privacy Policy.

15. Amendments

ELKE may revise these Terms & Conditions from time to time.

Updated Terms shall become effective upon publication on the website.

Continued use of ELKE constitutes acceptance of the revised Terms.

16. Governing Law

This Agreement shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Coimbatore, Tamil Nadu.

17. Acceptance

By registering on ELKE, the Seller confirms that they have read, understood and agreed to these Terms & Conditions.
